These Terms and Conditions govern your access to and use of the Screen Illawarra website, including any content, memberships, member and industry directories, events, programs, merchandise, online purchases and other services made available through the website.
By accessing or using this website, creating an account, purchasing or renewing a membership, purchasing a product, registering for an event or program, submitting information to a directory or otherwise using our services, you agree to these Terms and Conditions and our Privacy Policy.
If you do not agree with these Terms and Conditions, you should not use this website or our services.
2. About Screen Illawarra
Screen Illawarra is a not-for-profit organisation supporting the development, promotion and growth of the screen industry in the Illawarra and surrounding regions.
Throughout these Terms and Conditions, references to “Screen Illawarra”, “we”, “us” and “our” mean Screen Illawarra and its authorised representatives.
References to “you” and “your” mean any person accessing or using our website or services.
3. Use of This Website
You may use this website for lawful purposes and in accordance with these Terms and Conditions.
You must not use the website:
* for any unlawful, fraudulent or misleading purpose;
* in a way that may damage, disrupt or interfere with the website or its operation;

6. Membership Fees, Renewals and Cancellations
Membership fees and the applicable membership period are displayed on the Screen Illawarra website at the time of purchase.
Unless otherwise stated, membership fees are payable in advance for the applicable membership period.
Where automatic renewal is offered and selected, the applicable membership fee may be charged to the payment method provided at the beginning of each new membership period.
Members are responsible for ensuring their contact and payment information remains accurate and current.
Screen Illawarra may change membership fees, benefits or inclusions from time to time. Where reasonably practicable, members will be notified of material changes before their next renewal.
Members may request cancellation of their membership or automatic renewal by contacting Screen Illawarra or using any cancellation functionality made available through their online account.
Cancellation of a membership does not automatically entitle the member to a refund for any unused portion of the membership period.
Screen Illawarra is not required to provide a refund where a member changes their mind, no longer wishes to use their membership, fails to use available membership benefits or services, or where their personal circumstances change.
Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy available under the Australian Consumer Law or any other applicable law.
7. No Guarantee of Professional Outcomes
Screen Illawarra supports and promotes the regional screen industry but does not guarantee that membership, directory inclusion, event attendance, participation in a program or use of the website will result in:
* employment;
* casting opportunities;
* production work;
* representation;
* funding;
* investment;
* professional advancement;
* business opportunities; or
* any other particular professional or commercial outcome.
Any professional or commercial decisions made as a result of information, opportunities or connections obtained through Screen Illawarra remain the responsibility of the individuals and organisations involved.
8. Member and Industry Directories
Screen Illawarra may operate online directories, including directories for actors, crew, screen businesses, locations, extras and other screen industry participants.
Information published in these directories may be provided directly by members, individuals, businesses or other third parties.
By submitting information, photographs, videos, showreels, links or other content for publication in a Screen Illawarra directory, you confirm that:
* the information you provide is accurate to the best of your knowledge;
* you have the right and authority to provide and publish the information and content;
* publication of the information or content does not infringe another person’s copyright, privacy, intellectual property or other rights; and
* you authorise Screen Illawarra to publish, display and use the submitted content for the operation and promotion of the directory and Screen Illawarra’s activities.
Screen Illawarra reserves the right to review, edit, reject, remove or request changes to directory listings where reasonably necessary.
Screen Illawarra does not independently verify every qualification, credit, experience, representation, business service or other claim appearing in a directory listing.
Inclusion in a Screen Illawarra directory does not constitute endorsement, accreditation, representation, recommendation or verification by Screen Illawarra.
Users are responsible for conducting their own enquiries and due diligence before engaging, employing, contracting with or otherwise relying upon any person or business listed in a directory.
9. User-Submitted Content
Where you submit photographs, showreels, biographies, credits, business information, location information, links, documents or other content to Screen Illawarra, you retain ownership of your content.
You grant Screen Illawarra a non-exclusive, royalty-free licence to use, reproduce, publish, display, format and distribute that content where reasonably necessary to:
* operate the website and directories;
* provide membership services;
* administer events, programs and initiatives;
* promote Screen Illawarra and its activities; and
* communicate information about the Illawarra screen industry.
You are responsible for ensuring you have all necessary rights, permissions, releases and licences required to submit and authorise the use of your content.
You may request the removal or amendment of your content by contacting Screen Illawarra, subject to any legal, administrative or record-keeping requirements.
10. No Endorsement

Users are responsible for conducting their own enquiries before applying for, participating in or entering into arrangements relating to any opportunity.
12. Events and Programs
Screen Illawarra may promote, organise or support events, workshops, networking activities, professional development programs and other initiatives.
Additional terms, eligibility requirements, ticketing conditions, cancellation conditions or refund policies may apply to particular events or programs.
Where additional conditions apply, they will be communicated as part of the relevant registration, application or ticketing process.
Unless otherwise stated in the conditions applying to a particular event, Screen Illawarra is not required to provide a refund where a participant changes their mind or is unable to attend an event.
Where permitted, Screen Illawarra may allow a ticket or registration to be transferred to another person at its discretion.
Screen Illawarra may change, postpone, relocate or cancel an event or program where reasonably necessary due to circumstances beyond its control, insufficient registrations, operational requirements, safety concerns or other reasonable circumstances.
Where Screen Illawarra cancels an event and does not provide a suitable alternative, participants who have paid to attend the event will be entitled to an appropriate remedy, which may include a refund, in accordance with the Australian Consumer Law.
Where an event is postponed or rescheduled, Screen Illawarra will communicate the available options to affected participants.
Nothing in this section excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law.
13. Online Purchases and Merchandise
Screen Illawarra may sell merchandise and other products through its website.
All prices are displayed in Australian dollars and include GST where applicable, unless otherwise stated.
Products may be manufactured, printed, fulfilled and delivered by third-party service providers.
Screen Illawarra makes reasonable efforts to accurately display product descriptions, images, colours and specifications. However, the appearance of products may vary slightly from images displayed on the website due to manufacturing processes, printing methods, screen displays and other reasonable variations.
Product availability is subject to change.
Screen Illawarra may cancel and refund an order where a product is unavailable, an incorrect price has been displayed, a technical error has occurred or the order cannot reasonably be fulfilled.

14. Shipping and Delivery

Orders containing products supplied by different fulfilment providers may be shipped separately and may incur separate shipping charges. Any applicable shipping charges will be displayed during checkout before the customer completes their purchase.

Screen Illawarra and its fulfilment providers will take reasonable steps to process and deliver orders within the stated or otherwise reasonable timeframe.
Delivery may be affected by circumstances outside Screen Illawarra’s reasonable control, including carrier delays, supply chain disruptions, severe weather events and incorrect delivery information provided by the customer.
Customers are responsible for providing accurate and complete delivery information when placing an order.
If an order cannot be delivered due to incorrect or incomplete information provided by the customer, additional delivery costs may apply before the order can be resent.

15. Returns, Refunds and Consumer Guarantees
Screen Illawarra’s goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
Depending on the circumstances and nature of the problem, customers may be entitled to a repair, replacement, refund, cancellation of a service or compensation where goods or services fail to meet applicable consumer guarantees.
Products sold by Screen Illawarra must, among other requirements:
* be of acceptable quality;
* be fit for any purpose made known to Screen Illawarra before purchase;
* match their description; and
* comply with any other applicable consumer guarantees under the Australian Consumer Law.
Services supplied by Screen Illawarra must, among other requirements:
* be provided with due care and skill;
* be fit for any purpose made known to Screen Illawarra; and
* be supplied within a reasonable time where no specific timeframe has been agreed.
Change of Mind
Screen Illawarra is not required to provide a refund, replacement or exchange where a customer simply changes their mind about a purchase, membership, event registration or other service.
Screen Illawarra may choose to provide a change-of-mind refund, exchange or credit at its discretion.
Any discretionary change-of-mind policy does not affect a customer’s rights under the Australian Consumer Law.
Faulty, Damaged or Incorrect Products
If a product is faulty, damaged, materially different from its description or otherwise fails to meet a consumer guarantee, customers should contact Screen Illawarra within a reasonable period after discovering the issue.

Screen Illawarra will not impose an arbitrary time limit that restricts a customer’s rights under the Australian Consumer Law.
Products Fulfilled by Third Parties
Some Screen Illawarra merchandise may be manufactured, printed or delivered by third-party fulfilment providers.
Customers who purchase products through the Screen Illawarra website should contact Screen Illawarra in the first instance regarding faulty, damaged, incorrect or missing products.
